Musk’s explanation for his famous “poop emoji” response to Twitter’s CEO’s long talk about spam bots was almost as short as the original, rude comment.

Musk tweeted the emoji on May 16 in response to a long thread by Twitter CEO Parag Agrawal, who supported the company’s claim that less than 5% of its users were fake accounts.

In a new tweet on Thursday, Musk responded to Twitter’s use of the conversation in its lawsuit to force Musk to finish buying the company for $44 billion. He said that his use of the obscene emoji meant that he thought Agrawal’s claims were “= bs.”

The tweet and others were used by Twitter’s legal team as proof that Musk “violated his commitments” in the original merger agreement, in which he agreed to buy the social media business.

“Since signing the merger agreement, Musk has consistently said bad things about Twitter and the deal, putting Twitter’s business at risk and putting pressure on its share price to go down,” Twitter’s lawyers said in a lawsuit filed Tuesday.

Twitter also said that Musk broke the merger agreement’s “secrecy clause” more than once.

Musk pulled out of the deal on Monday, citing concerns about spam accounts among its users. In a brief, his side said that Twitter had not answered any of the many requests for verification information.

Even though the legal battle in Delaware chancery court is just getting started, most people think Twitter has a strong case in its effort to force the acquisition to go forward. The merger agreement with Musk had a $1 billion fee that Musk might have to pay if he wants to back out.
